Are
Police Cars Considered Commercial Vehicles?
- "no", according to Florida State Attorney
General -
The Property Management Company has
been fielding a few questions on the
subject of Police cars being commercial vehicles or
not. From time to time
the question is raised at Community meetings as well,
"Is a marked police
vehicle assigned to a law enforcement officer a commercial
vehicle?"
Florida State Attorney General Charlie Crist provides
an advisory legal
opinion the the link listed below. To summarize: Florida
Statutes, defines
a "commercial vehicle" as "a vehicle
that is owned or used by a business
or any other entity conducting business for a commercial
purpose." A
"commercial purpose" is defined to mean "for
the purpose of economic
gain." The provision of law enforcement services
is an integral and
constituent part of government. Clearly, the provision
of law enforcement
services does not constitute a commercial enterprise.
